Please read these Terms & Conditions carefully before using the Resurge India Foundation website and before making any donation. By using the Site or making a donation you accept and agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site or make a donation.

1. Definitions

  • “Foundation”, “we”, “our”, “us” — Resurge India Foundation (Reg. No. 181/4/22).

  • “Site”www.resurgeindia.org and any pages, portals, or payment interfaces hosted by or for the Foundation.

  • “Donor”, “you”, “your” — any person or organisation that uses the Site and/or makes a donation to the Foundation.

  • “Payment Gateway / Payment Processor” — third-party service used to process electronic donations (cards, UPI, net-banking, wallets, ACH/auto-debit, etc.).

  • “Donation” — any voluntary financial contribution made to the Foundation via the Site or other channels.

2. Acceptance of Terms

Use of the Site, creation of a donor account (if any), and donations are subject to these Terms & Conditions and any other policies incorporated by reference (including the Foundation’s Privacy Policy). By using the Site or making a donation you confirm you have read, understood, and agree to these Terms.

3. Copyright, Trademarks & Permitted Uses

All materials on the Site, including text, images, logos, design, and code, are the property of Resurge India Foundation or its licensors and are protected by copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable license to view, print, and download materials from the Site solely for informational and non-commercial purposes, provided you do not remove copyright, trademark, or other notices. Any other use (including reproduction, republication, distribution, adaptation, transmission, or display) without express written permission is prohibited.

The Foundation’s name, logo, and other marks are trademarks of the Foundation and may not be used without prior written consent.

4. Donations — General Terms

  1. Purpose of Donations. Donations are accepted by the Foundation to further its charitable objectives. The Foundation will use donations in accordance with its mission and governing documents. Donors understand and accept that donations are voluntary and, once accepted and applied, generally cannot be revoked except as described in Section 7 (Refunds & Reversals).

  2. Irrevocability. Subject to applicable law and the refund policy below, donations made via the Site are irrevocable once processed by the Payment Processor and credited to the Foundation’s account.

  3. Acknowledgement & Receipts. The Foundation will issue donation acknowledgements or receipts in the form it deems appropriate and in accordance with applicable laws. Issuance of a tax-deductible receipt (e.g., under section 80G) is subject to the Foundation’s current registration and the donor’s eligibility. Donors seeking receipts for tax purposes should consult a tax advisor. The Foundation does not guarantee tax-deductibility of any donation; if applicable, the Foundation will provide receipts only where allowed by law and registration status.

  4. Minimum & Maximum Limits. The Foundation may set minimum/maximum donation limits and may change those limits without prior notice.

5. Payment Gateway & Processing

  1. Third-Party Processing. All online donations are processed by third-party Payment Gateways selected by the Foundation. By making a donation you authorize the Foundation and the Payment Gateway to process your payment information. You agree that the Foundation is not responsible for the actions, errors, omissions, or failures of any Payment Gateway.

  2. Security Compliance. The Foundation requires Payment Gateways to comply with industry-standard security requirements (for example PCI DSS for card payments, TLS/HTTPS for web connections) and applicable Indian laws (including any rules under the Information Technology Act). Donors expressly acknowledge that card, UPI, and other payment credentials are handled by the Payment Gateway, not stored on the Foundation’s servers (unless a donor expressly consents to tokenization or similar services), and that the Foundation may retain minimal transactional metadata for record and audit purposes.

  3. Authorization & Settlement. Donation transactions require authorization by your bank/wallet/UPI provider. The Foundation cannot guarantee immediate settlement; an authorized transaction may still be declined during settlement. The Foundation is not liable for any delays or failures in authorization or settlement by financial institutions or Payment Gateways.

  4. Fees & Charges. Payment processors and banks may charge transaction processing fees. Unless explicitly stated otherwise, the Foundation will not be responsible for these third-party fees; such fees may be deducted from the donation amount before transfer to the Foundation. Where the Site offers an option for donors to cover processing fees, donors must select that option prior to confirming the donation.

  5. Currency & Conversion. Donations may be accepted in Indian Rupees (INR) and/or other currencies as specified by the Site. Currency conversion costs and exchange rate differences are the donor’s responsibility where applicable.

6. Recurring Donations & Cancellation

  1. Recurring Authorizations. If you authorize recurring donations (automatic periodic debits), you authorize the Foundation and the Payment Processor to charge your chosen payment instrument according to the schedule you select. Recurring donations will continue until cancelled.

  2. Cancellation. Donors may cancel future recurring donations at any time by logging into their donor account (if available) or by contacting the Foundation through the Site’s contact form. Cancellation requests will be processed promptly but may not affect charges already in-process at the time of cancellation. The Foundation is not liable for charges made before cancellation takes effect.

  3. Failed Recurring Charges. The Foundation may attempt to retry failed recurring charges. If repeated attempts fail, the Foundation may suspend or cancel the recurring donation and notify the donor.

7. Refunds, Chargebacks & Reversals

  1. Refund Policy. Refunds are granted only in exceptional circumstances at the Foundation’s discretion (for example duplicate payments, processing errors, or proven unauthorized transactions). Requests for refunds must be made via the Site’s contact form within 30 days of the transaction. The Foundation may require documentation and will coordinate with the Payment Gateway and banks. Processing or administrative fees may be deducted from refundable amounts to the extent permitted by law and by the Payment Gateway.

  2. Chargebacks. If a donor initiates a chargeback with their bank or payment provider, the Foundation reserves the right to recover funds, provide necessary documentation to defend the transaction, and pursue legal remedies if required. Donors are requested to contact the Foundation via the Site prior to raising chargebacks so that disputes can be resolved directly.

  3. Reversal for Non-Compliance. Donations obtained by fraud, misrepresentation, or material mistake may be reversed. The Foundation reserves the right to reclaim donated funds if necessary and to cooperate with law enforcement.

8. Donor Representations & Warranties

By making a donation you represent and warrant that: (a) you are authorized to use the chosen payment method; (b) the information provided by you is accurate and complete; (c) you are not acting in violation of any applicable law; and (d) you will promptly notify the Foundation of any unauthorized use of your payment method.

9. Use of Funds & Reporting

The Foundation will use donations in furtherance of its charitable objectives and in accordance with its governing documents. The Foundation will maintain accounting records and make reports as required by applicable law and regulations. The Foundation may publish aggregated impact reports; such publications will not disclose individual donor personal information without consent.

10. Privacy & Data Protection

Donor personal information collected in connection with donations is handled pursuant to the Foundation’s Privacy Policy and applicable data protection laws. Payment credentials (full card numbers, CVV) will not be stored by the Foundation unless explicitly agreed and only if stored in compliance with applicable security standards; typically such sensitive data is handled exclusively by the Payment Gateway. By donating you consent to the collection, processing, and transfer of your information as described in the Privacy Policy.

11. Anti-Money Laundering & Compliance

The Foundation reserves the right to verify donor identity and source of funds to comply with anti-money laundering (AML), counter-terrorism financing (CTF) laws, and other legal requirements. The Foundation may decline donations or suspend donor accounts where there are reasonable concerns about legality or reputation risk, or where required information/documentation is not provided. Donations that might interfere with the Foundation’s charitable status may be refused.

12. Linking, Embedding & Framing

You may create links to the Site provided you do not misrepresent your relationship with the Foundation or its content. Hotlinking, framing, or embedding the Site’s content in a way that removes Foundation notices, adverts, or donor acknowledgements is prohibited. Please notify the Foundation of any proposed linking by using the contact form on the Site.

13. Disclaimers & Limitation of Liability

  1. No Warranties. The Site and all materials are provided “as is” and “as available” without warranty of any kind. The Foundation disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement to the fullest extent permitted by law.

  2. Limitation of Liability. To the maximum extent permitted by applicable law, the Foundation and its officers, trustees, employees, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Site, donations, Payment Gateway services, or these Terms, even if advised of the possibility of such damages. The Foundation’s aggregate liability for direct damages shall be limited to the amount of donations actually received by the Foundation from the donor in the 12 months preceding the claim.

  3. Third-Party Sites & Services. The Foundation is not responsible for third-party sites, Payment Gateways, or services linked from the Site. Use of third-party services is at the donor’s risk and subject to those third parties’ terms.

14. Indemnity

You agree to indemnify and hold harmless the Foundation and its trustees, officers, employees, agents, and service providers from any claim, demand, loss, liability, or expense (including legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

15. Technical & Integration Requirements (for Payment Gateways)

To ensure secure and compliant payment processing, donations made via the Site require the following, and the Foundation will work with selected Payment Gateways to maintain them:

  • Use of TLS/HTTPS for all payment pages and API endpoints.

  • PCI DSS compliant processing; card data must not be stored on Foundation servers unless compliant tokenization is used.

  • Support for secure webhooks and signature verification for asynchronous event notifications (payment success, failure, refund).

  • APIs for refunds and reversals to facilitate the Foundation’s refund policy.

  • Support for recurring payments (with standard mandate/consent flows) where donors opt in.

  • Detailed transaction logging and reconciliation to enable audits.

  • Mechanisms for handling failed transactions, retries, and chargeback notifications.

These measures help the Foundation meet bank, regulatory, and Payment Gateway requirements.

16. Changes to These Terms

The Foundation may modify these Terms at any time by posting updated Terms on the Site with the “Effective date”. Continued use of the Site or making donations after such posting constitutes acceptance of the revised Terms. Where practical and material changes are made to donation processing (e.g., refund procedures or recurring donation mechanics), the Foundation will make reasonable efforts to notify donors.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms, including disputes regarding validity, breach, or termination, shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the Foundation’s registered office. Parties will first attempt to resolve disputes amicably through good-faith discussions before pursuing formal legal remedies.

18. Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms (together with the Privacy Policy and any other documents incorporated by reference) constitute the entire agreement between you and the Foundation regarding use of the Site and donations.

Please include transaction details (date, amount, transaction reference) where applicable to help us respond promptly.

20. Miscellaneous

  • No Offer of Employment or Goods. Donations do not create any employment, partnership, or goods/service contract with the donor.

  • Promotional Campaigns. Specific fundraising campaigns may carry additional terms; those will be posted alongside campaign materials and shall supplement these Terms.

  • Transparency Commitment. The Foundation is committed to responsible stewardship of donated funds and will maintain reasonable financial controls and transparency in accordance with applicable laws and best practices for charitable organisations.
